Hello, ILaqa magistrate had ordered to register a FIR under crpc156(3). In this FIR police inquire the matter and submit the cancellation report, after this complainant did not take any action in this matter. so I want to know that we should have to go in high court to cancel the FIR that the complainent can't take any action because the FIR was lodged knowingly/Under a conspiracy. Or it has been automatically cancelled. Kindly suggest. Thanks , Mani
as per your stated facts, if police officer already submitted cancellatiok report in yout favor, then dont worry you dont have to do anything in this regard..now its complainant turn to challange the cancellation report.

that it is a matter of record on what ground police has cancelled the fir and if the concerned police has cancelled the same then there is no need to go to any court for quashing of fir or to ran here and there sir

You need to approach the high court for cancellation of FIR once the same has been registered. Police cannot cancel the same nor the court of judicial magistrate. FIR never got cancelled automatically even if the complaint does not persue his complaint.
