Compounding sec 419, 420 case with POLICE

09-Mar-2023 (In Criminal Law)
Hello respected members, An FIR has been filed by police under section 419, 420 against us for hacking a computer of a company. POLICE has proof but the VICTIM (The company) is not even ready to accept that their system was hacked. In this case, the complainant is POLICE OFFICER and not the victim (the company), how to compound this case? Please help. Can compounding be done with COMPLAINANT (Police officer) in this case? Victim wants nothing to do with this FIR, it is between us and the POLICE only. Please help. For further discussion, I will pay.

An offence of Section 420 is compoundable but with permission of the court. And if the victim company whose system was hacked then there’s no case against you. The matter can always be filed under plea bargaining. And the FIR can be quashed by the High Court.

We can get it quashed because if company doesn’t have any say in regard to hacking and police on its own has registered a case then we need to state before High Court that this case has no basis for FIR and waste of time and harassment on personal basis.

In the given circumstances the police are well within their rights to proceed with the investigation.

You shall approach the High Court for quashing. Additionally, you may proceed with the trial and criminal defence.

In the defence, you shall seek compounding of the offence which I believe should be granted in the present circumstances.
