Advice for my friend. The issue relates to sexual abuse & blackmail

07-Feb-2023 (In Criminal Law)
My friend met a guy on a social media platform who claimed to be divorced at that time. My friend was also divorced. Later he proposed to my friend to which she accepted his proposal. Initially everything seemed fine but after some time he wanted my friend to have sexual ties with him to which my friend refused. my friend expected him to get married with her. He was not ready for that at that time but later he did a fake promise pf marriage with the intention of having sexual relationships with her . He succeeded this intention and convinced my friend. My friend later found out from his ex girlfriend with whom he also has a child .she told my friend that he was a womaniser and he had been in many such false relationships with other females and also he is already married. When my friend confronted him and threatened him to complaint he tortured her physically and mentally. What all remedies are available with my friend? What all sections are chargeable against him ?

If there’s is a sexual relationship and the guy has done this with the fake promise of marriage then it clearly attracts section 376 which is Rape. It can also attract 420 because you were cheated by him to develop relationships. You must immediately file a complaint. For legal assistance I am just a call away.

Yours is a criminal offence, you have to approach the nearest police station and you have to give thei true facts with evidences, make sure not to give any false evidence regarding anything at all. Write your complaint in short format and you have to submit the same to the concerned police station, it may attract section 376 IPC 354 and 420 and other sections accordingly thank you

it is kind of a grevievce offence which can cause him a jail time over 7 years . but if u try to settle the case under mediation u can settle the case with easy plea with no punishment . but it is all about u should act first .

Well, in this case you can complaint in the Women cell near your jurisdiction and also in Cyber cell and also in nearest police station for cheating you and if u involve in sexual activities with him, in that case you first do your medical checkup, ensure you not pregnant or in case this is a ground to sue him in the court of law.

First of all my sympathy with the victim. More than filing a case, she needs to be taken care of as she is going through a trauma. She needs support at the moment. secondly, on the false promise of marriage, a case under 376 can be filed, and if she has been beaten or threatened by him, there are various other sections in IPC of intimidation, violence and physical hurt. contact me if you want the best piece of advice.

There are hell lot of remedies which your friend has and the biggest of those is the charge of rape on the false pretext of marriage which is section 376 IPC. Apart from that, since she has been physically tortured and beaten as well so for that voluntary hurt and criminal intimidation can also be put in.
