It’s depends on the amount of booking property bcoz district consumer forum has pecuniary jurisdiction of 20 lakhs above it matter should be filed in state forum and if ut exceed than u have to file in national forum and u can also file case in permanent lok adaalat that is also a remedy to recover the money without filing any court fees

Dear Client,
A case can be filed in the appropriate forum as per the requirement, there is a bifurcation of amount involved in the state as well as national forum. Now a days court are going very hard against such claims of the builders, this is common complaint from most of the clients, the builder firstly provides a scheme and later they are not able to pay so.

You cannot file a case in consumer forum as it is not applicable on transactions done for commercial purposes.
As far as early recovery of the money is concerned you might have an option for filing a suit for specific relief. But your agreement will need to be reviewed for a concrete and precise advise.

Yes, sir you can file a case in consumer forum in an appropriate forum and also you can file a case of Forgery and along with a cheating against the directors of that company. Either you can file a case for Recovery or in consumer forum that depends upon you but my advise to you is to file it in consumer forum as for filing ORDER 37, the court fees can go up to 8 percent of the total valuation of the principal amount of recovery.
