No it cannot be done since he may misrepresent and take the share and you have to bring your presence before the court and show how the legal heir has misrepresented and also you can file case with court permission and get what he has claimed your share.

Your question is vague. But without consent in writing properties cannot be taken by co-sharer. There must be some document to claim property of other legal heir. Try to get all the relevant documents from the concerned Court/office then you will get exact and proper advise.

A legal heir means some one with a legal right to inherit that property and naturally if there are two such heirs to one property one cannot take whole of it without the other. If any one has done so, it must be by concealing the existence of other heir and that other can challenge such action by filing appropriate suit in civil Court.

Please know that each legal heir has got his own right to take his property as such one legal heir cannot be permitted to take the property the property of an other legal heir without the presence of all the legal heir. Individual right can only be taken by the other on the authority as permissive under the law.

Question: in a property can a legal heir take the property of an other legal heir without the presence of all the legal heir? No, when it was inherited property and then each of the legal heirs will become the successor. Then each one have joint interest/right in the said property. You cant take others share without his presence and consent.
