Procedure to buy mortgaged flat having outstanding of around Rs 12lacs

Hi I want to buy a flat has outstanding pending of 12L,I have 8L with me and asked seller to pay rest amount to bank to clear running loan. So that I can initiate with fresh loan. Please suggest me a legal process to furnish this at minimum risk.

Take the bank detail from seller and try to settlement amount from bank and after settlement amount paid the amount through seller ,then you buy the flat or take over loan process from bank you buy the flat.
