Need to know validity of orders from lower courts

11-Jun-2023 (In Civil Law)
The revenue authrites passed orders by declaring 90 persons as tenants in our issue without any proof of evidence, the same orders confirmed by the commissioner of survey, we challenged the same in writ petition in high Court, the high Court division bench along with some other writs of our issue passed common order by declaring the persons ineligible as there was no evidence with regard to tenancy. The order stood unchallenged. While so, in a separate suite for injection the supreme court held that the order's of revenue authorities not challenged by us, hence the persons before the Court were confirmed as a tenants I.e 13 people for the limited extant 19 acres out of 180 acres, the remaining possession of the land confirmed in our favour, but the order of the high court division bench is not heard or mentioned in decision of supreme Court. My question is the orders of division bench are in live or not?

Hello,

The order of the high court division bench is not live as the order of the supreme court supersedes any order passed by high courts. You can file a review petition in supreme court and apprise the supreme court about the order of the high court division bench and the suppression of facts about the proceedings of the high court division bench before it by the petitioners in the supreme court and the fraud played by the petitioners in obtaining the order. I hope this helps.
