Civil Case of tenanted property where one is NRI.

We live in a rented property in Kolkata inherited from my demised father.We are three sister two married and living in Mumbai and a brother who is an NRI in USA and my mother is living.The bill is drawn in my brother's name.No fresh agreement has been made with landlord after my father's death.Who will be acknowledged as legal tenants now.
After the demise of the original tenant, it's not necessary that every son or daughter or wife of the original tenant will inherit it. there is no specific rules. but at the time of death of the original tenant, his existing family members who reside with him, are the present tenant.
