hello client as i can see ur issue is really serious . been father of the child you should have visitation rights. for sure. in this matter for custody of the child the age of the child matter a lot. as you want visitation rights tht you will get as propert and primary remady . but for all this things and remady propert legal steps is required as necessary through high court.

Being a biological father you have a right of custody or visitation and mother can’t stop you to have the same unless any order is passed in contrary. You would be required to file for the custody of your son, however the age of the child matters while granting the custody. Also the while granting the custody, the court only looks for the better welfare of the child. Sometimes, the court may call upon the child and hear the wish, however in case of minor child the court only sees the welfare at most and not the statement of the minor. It doesn’t take long time in grant of visitation right. However, the time depends on case to case basis. It is not mandatory to call the child for visitation only in court. If your wife is not allowing you to visit your child, you must file petition in court. Although, I would suggest you to have face to face meeting because only then I can understand your case better and could suggest you specific remedy.
