Collect the bank acknowledgement from your bank and issue registered legal notice to the accused through your lawyer it should be within 30 days from the date of cheque bouncing and it has to be replied from the other side within 30 days if he fails to reply or replies through denying to pay then within 15 days after that you can file a complaint at Majistrate Court under Section 200 of CrPc for the offence punishable under Negotiable Instrument Act 138. Its over all 75 days time limit, consult your advocate.

Dear sir,

The first plan of action is that you will have to issue a legal notice informing them about the dishonour of the instrument, subsequent to which you shall afford them 15 days to return the money. at the end of the 15 days if they fail to repay the cheque amount we can file a case against them under Section 318 of the Negotiable Instruments Act
