Person put cheques without telling me, now case filled u/s 138

i gave 2 PDC cheques to a persone for buying a second hand car , after few days he refused to sell and didnt return the cheques , sent them for banking without informing me and now we are in court ( U/S 138 NI act ) now what can i do .

It is very surprising that you already engaged a lawyer and your matter is sub judice, but still you are uneccessary asking silly questions. You keep faith on your lawyer, we never interfere in the procedure of your lawyer. You ask your lawyer for your query.

sir,
if person file a complaint case under se. 138 n.i.act against you. then you hire a advocate and watch your matter in court what proceeding in complaint case. you file a revision for challenging lower court notice order in district court..

So for as section 138 NI Act is concern if A cheque is given to anybody for any different purpose instead of any debt payment and if that purpose could not met out then it is the duty of you to get return that cheque. Though people forget that cheque is a written document and may be misused better if you contact with overall case papers.

As per your query. PDC cheques will not enforce any legal liability unless the document will specifically make it enforceable. Therefore there is no case made out against you, at the face of your query. But for more suitable safeguard against the case, you are advised to bring your relevant documents to us.
