No progress in Judicial Magistrate FirstClass court

Dear Sir / Madam, There is no movement in my case that is filed in JMFC court in 2 years now, there is no verdict as well, can I appeal in CJM or Session court to expedite. Also do I have to change my current lawyer, if yes or no and what is the process if he refuses for NOC. Thank you

Well, if you want to see any movement in your case, then, you have two options : Either to lodge a Complaint to the Principal Judge of the concerned Magistrate Court or file a case in High Court to expedite your case!

A lawyer must never refuse to provide you the NOC. It is ultimately the client's decision to get the lawyer of his choice. You may file application to HC for expediting the case, but there shoud be extraordinary circumstances in your case for expediting the case. It cannot be allowed as a matter of convenience. Well, in order to expedite your case, you have to lodge a Petition before the concerned High Court of the State in which your matter before the CJM is going on! You need to put forth the details of the delay caused by the concerned Magistrate in Hearing your Case!
