Questions Answered by Advocate Pankaj Bajaj

Q: About In validity Of Talak E Ahsaan

Some lawyer said pronounciation of any talak out side court is invalid as per muslim women marriage protection of right 2019 act. But some says divorce can be done out side court through talak e ahsan. Is this act only about tripal talaq or all form of pronunciation talaq?

Advocate Pankaj Bajaj answered
In India, Talaq-e-Hasan can be effected without court intervention, but it's essential to understand the process and implications. Talaq-e-Hasan is a type of divorce where the husband pronounces divorce three times over three consecutive menstrual cycles. To effect Talaq-e-Hasan, the husband must:- Pronounce the divorce formula once in each of the three consecutive menstrual cycles- Abstain from sexual intercourse with his wife during this periodAfter the third pronouncement, the divorce becomes irrevocable, and the couple must wait for the Iddat period (usually three menstrual cycles) before the divorce is finalized. While Talaq-e-Hasan can be done without court intervention, it's crucial to note that the Indian government has taken steps to regulate and restrict certain types of divorce, including triple talaq, which was declared unconstitutional by the Supreme Court in 2017.Additionally, the Muslim Women (Protection of Rights on Marriage) Act, 2019, makes it illegal for a husband to divorce his wife through instant triple talaq, and provides for penalties and safeguards for Muslim women. In summary, while Talaq-e-Hasan can be effected without court intervention, it's essential to be aware of the legal framework and implications.

Q: Money and gold chain recovery from my ex boyfriend

My ex boyfriend took 20k money and my gold chain by telling lie and he manipulated me by saying he will return it in 15 days but it's been 1 and half year he is still not returning it what should I do

Q: Need money back from unknow third party person

Hi, I am working professional in a private firm has transferred money online as a bribe to a unknown third party person got to know through office colleague online using UPI to help me secure a position in another company for employment purpose, but later on that third party person backs out of said promise and not returning the calls or money back, so in this case is the person giving money as a bribe for employment in a private company liable for any punishment under any Indian law?

Advocate Pankaj Bajaj answered
Well certainly not, you gave money as a favor in form of fees to someone to get you employed in a Private Company, not as a bribe, so you can file a case against that person who duped you by taking fees from your end and in return not gettting you employed in such a private company. However, no case can be filed against him if that third party person who duped you has not given guarantee to get you employed in exchange of money.

Q: Need help regarding the complaint against absconding builder

I am raising a complaint against the builder who has defrauded the MAHARERA site for compensation under section 31. Is the section correct?

Advocate Pankaj Bajaj answered
Well, Section 31 of the Maharashtra Real Estate (Regulation and Development) Act, 2016 (MahaRERA) deals with the obligations of promoters (developers) regarding the veracity of the advertisements or prospectus issued by them. This Section has got nothing to do with Compensation!

Q: Not able to recover the loan given to a friend

My friend needed financial help so I took a loan of 75000 for him because he promised that he will pay the installment on time. But this month he didn't pay the installment and now he is neither answering my call not replying to my messages on WhatsApp. As a proof I have a WhatsApp chats and payment screenshot. Is it enough to file a complaint against him?

Advocate Pankaj Bajaj answered
Well, you have the sufficient Documentary and Electronic Evidences available with you to proceed forward with filing your case. A strong case of Cheating can be filed against your friend, who is intentionally ignoring you, so that, he does not have to repay your money.
