my cheque bounced due to fund availability

my cheque is bounced and i got massage from bank. If the cheque payee is sending notice and i have not received then what may be problems and solution as per your knowledge. waiting for your reply Thanks

If you have not been received the notice then they are required for them to send the notice to you so as to initiate legal proceedings. It will be better for you to negotiate or settle the matter or in the alternative contest the case in a court of law. thanks and regards

Dear client, If cheque is bounced and notice send has not received and your address is not fake , then you may be liable as taken. if your address has not been found , post remarks is 'not found , not traceable ,then you may escape this liability, But if any how your address is traced then you .ay be liable for doing fraud ,cheating. Query perused. If your cheque has got dishonoured and now the payee is sending the mandatory notice under section 138 Negotioable instruments Act you should either pay or rebut the notice by an appropriate reply through your lawyer. For further consultancy and legal services you may contact us.

Hi, A cheque issued to a payee means you have a legal liability which has to be discharged as per the agreement (not necessarily a written one) between yourself and the payee. If there was no sufficient balance in your account on the date the cheque was presented for payment, then the payee can send you a legal upon receipt of the bank memo about the dishonor of the said cheque, followed by the prescribed time limitation for the payee to follow for legal remedies against you. If the payee fails to act upon on a timely manner you may have a relief else he/she can file a case U/S 138 of the NI Act and also seek interim compensation upto 20% of the cheque amount U/S 143 of the Act.
