As per the law if any cheque is issued it is presumed that the cheque is issued towards a legally enforceable debt, unless the same is being challanged by the drawee. The presumption is in the favour of the person to whom the cheque is issued.

A Cheque only establishes responsibility of Drawer , [ person who orders a Bank to withdraw money from an account to pay a designated person a specific sum. A Cheque also identifies a Drawee or Payee - to whom money is to be paid....a person to whom a Cheque is made payable ]....Apart from this a Drawer can claim through some agreement or contract that he issued the Cheque towards payment of partial or complete debt....burden of proof will then fall on Payee to prove otherwise....It is always better to mention relevant Cheque Nos in any agreement....
