Filing a single case for several cheque bounce cases

Sir, Is it required to file different cases for different bounced cheques. I have received 5 cheques from a customer to whom I supply goods on regular basis. All cheques were presented on a date and all were returned by the bank stating "funds insufficient". I have sent 5 notices to him but no answer has been received till date. Do I have to file different cases for the same or only one case mentioning all the bounced cheques can be filed in the court???

In one case you can file cases for three cheques, but not more than three cheques, but here as you have send five different notices, so it is advisable to file different cases for all the cheques , rest we can advise after seeing the notice.

Yes you will file only one case for different bounced cheques...you have file only one complaint ..you have to placed all cheques and notice in one complaint..detail of cheques you have to filled in one complaint..

queerest you did not mentioned the date when the cheques bounced as to file criminal case under N I Act their is time limit for Limitation is an important aspect for initiating proceedings u/s 138 or 141 of negotiable instruments act. You have to send a legal notice within 30 days from the date of return (dishonour) of cheque asking the noticee to pay the amount within 15 days. On expiry of fifteen days from the service of notice, you have to file a complaint before the Concerned magistrate within 1 month of the said expiry. However, it is pertinent to note that nothing precludes you from filing a separate civil suit (summary suit) for recovery of the amount due the limitation of which is 3 years

You can file a single complaint as well as separate complaint for each cheque. You have to prove that the cheque has been issued for a legally recoverable liability. For exact guidance consult your local counsel

You need to file the case within 45 days from the date you have sent notice. You may file one single case for all the chewues or file 5 different cases for your 5 cheques. But dont waste time and file it within the period of limitation of 45 days or you wont get any benefit out of it.
