Cheque of 13k bounced given by builder he is not responsing

Just file a case for recovery as soon as possible otherwise you would not be able to recover that amount pls do need full.as earliest as possible. There is nit other alternative. Kindly contact to a law

We need to serve him a legal notice within 30 days of information about the cheque bounce and provide him 15 days time to refund our amount and if he fails to do this, then we need to file complaint case within 30 days after lapse of 15 days time period in court of law.

Hi, You have to give a notice, failing which you can file a legal case against the builder .
There is a procedure in a cheque bounce case which has to be followed.

You are supposed to give a legal notice within 30 days from the day the cheque bounced (i.e. date on return memo) if you wish to pursue case under 138 NI Act. after notice if builder does not respond you have to file a case within the 45 days to recover the amount. if you fail to legal notice within 30 days then you cannot claim relief under the NI Act for dishonor of cheque

Please present the Cheque once again and if it bounces again, get a statutory legal notice u/s 138 issued to him. In the legal notice, you need to call upon him to pay in 15 days' time.
If he fails then you can initiate cheque bounce case u/s 13 of The Negotiable Instruments Act, 1881.
