Cheque issuing person and company ran away

Cheque issued by party bounced and party ran away from their given address,what to do now

Immediately report the incident to the police station by providing all the contact details of the person as well as social media handles. Police would be able to trace the person and can initiate criminal proceedings against him. Thanks

U can file a case of 138 and serve thru what’sapp email and else u can write it off as bad debts in u books Since the accused is not traceable court can’t do anything till u approach it Find their address from Bank using some connections may be that will help u

1. Trace out address of drawer party before proceeding with legal action. 2. Address is required to issue notice to the drawer. 3. Incase you are unable to trace current address, send notice to last known address of drawer. 4. If notice is returned with noting that addressee is not available at the address, then you must file complaint u/s 138 negotiable instruments act within 15 days of receipt of notice or 30 days of notice period. 5. you can also file summary suit for recovery of money and initiate criminal proceedings under section 420 ipc

You have lot of options apart from 138 NI matter like filling FIR then proceeding to take warrants against him then you can make bank as a party and proceed further there are lot of other options as well to recover it’s just a matter of time but need to have patience

Proceed with a cheque bounce case under NI Act. A warrant shall be issued by the court if the person fails to respond to the summon. You will need to file a case in this regard. Keep a copy of the bank remarks as those will be added as annexures. Additionally, you can drop a complaint at the police station belonging to your jurisdiction.
