Cheque got bounced on 4th march 2021


10-May-2023 (In Cheque Bounce Law)
I have given drawer a 15 days notice but he has not refunded the notice.And now I want to file case but there is lockdown and government has extended the lockdown. So if the limitation time gets exceed, can I file the complaint after lockdown I e. 15th May 2021

yes u can file after the lockdown but no need to wait as the filing department is each and every court is functional and you can file you case and get it listed after the lockdown so that process wont stop

Yes you can file complaint even after mandatory period which is provided by law. As limitation period is raise up till further order of Supreme Court. But you should be ready with your draft and file as soon as possible.

No need of worry you can file the case u/s 138 of N I Act. Filling of petitions is acceptable by courts. only hearing of matter other than urgent matters can not be heard. so either contact your lawyer who send the legal demand notice or get my contact details and contact me

Extension of limitation is already extended by the latest apex court order so if there’s any delay in filing of any suit arbitration proceedings and or negotiable instruments act then the Same will be taken up for filing currently in Bombay magistrates courts filing is accepted however there is no news of extension of lockdown in Mumbai

As per the Order passed by the Supreme Court , if the period of limitation has been expired between March last year and 2021, there would be a further limitation period of 90 days or the actual time for filing a case whichever is higher. Yes, you can file a complaint under Section 138 of Negotiable Instrument Act, 1881 after the limitation time gets extended and after the lockdown i.e.15 May ,2021.
