Q: mother signed will writing off everything to brother
my mother has signed a will where she has given everything to my brother. but for property title transfer he needs my signature on noc to be given to society. since will is already made and my mother passed away.. is there a way to claim from my brother..
Advocate Kunjita Shah answered
If you suspect that signature of your mother was taken under undue influence and fraud, then you can challenge the will. Also if you suspect forgery of your mother's signature, then too u can challenge the will.Normally witness in a will is not entitled to share in the property of deceased, who made the will. In any case you can obtain probate of the will and if you suspect foul, you can challenge before the court in probate proceedings.
