Q: Defamation suit against wife for false 498a FIR
Hi, I am an NRI and going through matrimonal dispute with my wife. She filed 498a FIR on me and my parents. I was out of India but my parents visited the police station twice. After 8 months while I was waiting for chargesheet to filed, I noticed that she had withdrawn the complain in court.(per court records).Can my parents file defamation case against her based on this?

Yes they can file a defamation case against your wife any time in the court and can claim compensation from her for the mental and physical harassement caused to them because of your wife and she will be held liable for the same in the court

Kindly some one explain below point in the event of arrest , surety of Rs 25000/- to be furnished . in case the arrest not happened then what is mandatory to submit the surety bond ?

No but at the tike when the chargesheet is filed in court then you have to apply for regular bail and at that time you have file a surety before the lower court and proceed with the matter that is what the procedure is all about and you have to comply accordingly

In my wife's maintenance case the judge has decided 8000 as fixed maintenance 5000 for grocery n daily needs and school fees separate till now I am able to understand what is the first 8000 maintenance constraint why he has not included grocery in 8000

That is the descretion of the court and the court has all right to pass the order and if you think that the order passed is not proper theb you have all the right to go the the upper court and challenge the order and get it modified depending upon the facts and circusmtances
