Section 9 and Section 13 of the Hindu Marriage Act are completely different. When your husband filed Section 9, his intention was cohabitation and reunion. You can use this as a strong legal ground to oppose his request to convert it into a divorce case.

Q: gift deed execution for flat in society

My uncle who is my dad's brother who owns a flat has executed a gift deed to his brother(who is my father) where he got full ownership. And after a span of 18 days my father executed the gift to his 2 sons with complete ownership.Both the gift deeds are duly registered and stamp duties are paid.Now my society is asking me why we have executed 2 gift deed in short span of time?. This question is related to Seperation. My husband did not take me at his home. Husband wants mutual divorce on basis of incompatibility. I told him we can go for marriage counseling and give our marriage another chance. But my husband is adamant and wants to go for mutual peaceful divorce. I was a homemaker in our marriage. Indirectly he said to me I am a educated woman I can work. So it does not seem he is willing to give any maintainence and one full and final alimony. We are living apart for almost 18 months now. (1) Any man who (i) follows a woman and contacts, or attempts to contact such woman to foster personal interaction repeatedly despite a clear indication of disinterest by such woman; or (ii) monitors the use by a woman of the internet, email or any other form of electronic communication, commits the offence of stalking: Provided that such conduct shall not amount to stalking if the man who pursued it proves that (i) it was pursued for the purpose of preventing or detecting crime and the man accused of stalking had been entrusted with the responsibility of prevention and detection of crime by the State; or (ii) it was pursued under any law or to comply with any condition or requirement imposed by any person under any law; or (iii) in the particular circumstances such conduct was reasonable and justified. (2) Whoever commits the offence of stalking shall be punished on first conviction with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine; and be punished on a second or subsequent conviction, with imprisonment of either description for a term which may extend to five years, and shall also be liable to fine.]
