Hi I gave someone 4.5 lakh ,he gave me two times cheque both time in return memo signature differ message . He said it's correct signature . He is neither giving money back by cash or online.his new cheque has been bounced its been 10 days .eed guidance on how to proceed .
Yes signature differs is one of the ground mentioned in memo and it attracts the offense under Negotiable Instrument Act. You have to issue demand notice as per law as it is mandatory provision. You have to wait dear for fifteen days from the date when he will receive notice and after that within thirty days you have to file complaint against him in court.

in this case if you have sent notice under negotiable instruments act then the statutory period for repayment by the other party is fifteen days.
after expiry of the said statutory period the crime is comminuted under NI act and you are entitled to file complaint against him within one month
