Resignation from naval service due to health issues of mother

24-Sep-2023 (In Armed Forces Tribunal Law)
Sir.. I m newly commissioned sub Lt of indian navy of executive branch which is involved in mostly sailing tasks.. I got commissioned 3 months earlier.. My mother earlier had pacemaker operation done.. Presently she is also working but since last two months her health has seriously deteriorated.. My younger brother has just now finished his engineering and he is moving to bangalore.. My mom has to stay alone now.. And even if i want to keep her with me.. I won't be with her and there will be no one to take care of our land properties.. Our relatives live distantly from delhi.. Hence everytym they can't come to help my mother.. As a result i m thinking of resignation from indian navy citing reason to take care of my mother.. Am i liable for it and if i provide original medical proofs would that help?

Dear Lt
The medical condition of your mother and your family commitment were probably known to you when you went for commissioning. None of these will constitute a reason for your release from service. If you decide to quit now you will be liable to pay the cost of your training which may be close to a crore in present situation. Legally not much can be done.
You may ask Navy for a posting to peace location where you may get a chance to take care of your mother.
Be brave you are a soldier.

Hi It happens many times that circumstances at home demands that you are required to attend your parents. If the situation is so you can ask for release from service on compassionate grounds which will be processed at Naval HQ. If it is agreed you can get released or else you can resign from your commission. You can follow proper channel to put up your release. If you need our help in this regard you can approach us. With best wishes.
