Hellow sir, I am having a dispute with my brother in law with respect to property he is not providing a share in property I am sharing the detail about the property here: 1. The notary of the land is on my grandfather's name and he is no more 2. There is no registry of the concerned property on anybody's name in my family 3. The person who sold his property to my grandfather had also passed away. 4. My brother in law is carrying on the construction work on the concerned land Tell me the solution which I can use to either take the possession of that property or dial and remains with No 1

Advocate Sunil Kumar Singh answered
In my view ancestral property is existing in your case if I am correct than you must file a civil suit for injunction, declaration and possession. Your brother-in-law is illegally constructing on the disputed land. It is suggested that you raise dispute in the Civil court. Opined accordingly

Q: Case is already closed but property is still not divided

Hi, i had a parental property in Katni(M.P), i was running a case against my brothers. My father died before 2005. i have won the case against them from the civil court in 2010 and again from jabalpur high court in 2012 and gain in gwalior in 2014. finally the property has been transfered to my name. but it is still not divided between us. will this hinder the situation. as the case is already closed in high court. please let me know as soon as possible.

if property has been transferred on your name then get the partition by filing partition suit. if cases have been already closed in your favour then there is no impediment for the same. noteworthy to say here that detail given by you are not complete so it is difficult to opine accurately. legal remedy open to you is to file partition suit, for further query in respect of your case you need phone consult to ascertain the legal position in your case.
