Firstly you need to file application under section 125 CrPC for maintenance for you and your child. You should also file and application for interim maintenance along with above application so that start getting some amount during the pendency of the application. Secondly if you want live with your husband then you need to file an application for restitution of conjugal right under section 9 of Hindu Marriage Act. But if you are inclined towards filing a divorce, I would suggest that you file an FIR under section 498a against your husband and in-laws (stating all the episodes of violence). Thirdly you need to file complaint it under tsection 12 Domestic Violence Act before magistrate. This complaint it is a quasi-criminal complaint and will be filed for getting back your sthreedhanam, compensation and restraining orders against your husband. सबसे पहले आपको अपने और अपने बच्चे के भरण-पोषण के लिए सीआरपीसी की धारा 125 के तहत आवेदन दाखिल करना होगा। आपको उपरोक्त आवेदन के साथ अंतरिम भरण-पोषण के लिए भी फाइल और आवेदन करना चाहिए ताकि आवेदन के लंबित रहने के दौरान कुछ राशि मिलना शुरू हो जाए।दूसरे यदि आप अपने पति के साथ रहना चाहती हैं तो आपको हिंदू विवाह अधिनियम की धारा 9 के तहत वैवाहिक अधिकार की बहाली के लिए एक आवेदन दाखिल करना होगा। लेकिन अगर आप तलाक दाखिल करने के इच्छुक हैं, तो मेरा सुझाव है कि आप अपने पति और ससुराल वालों के खिलाफ (हिंसा के सभी प्रकरणों को बताते हुए) धारा 498 ए के तहत प्राथमिकी दर्ज करें। तीसरा आपको मजिस्ट्रेट के समक्ष धारा 12 घरेलू हिंसा अधिनियम के तहत शिकायत दर्ज करने की आवश्यकता है। यह शिकायत एक अर्ध-आपराधिक शिकायत है और आपके पति के खिलाफ आपका श्रीधनम, मुआवजा और निरोधक आदेश वापस पाने के लिए दायर की जाएगी।
