Advocate Kartikeya Shukla answered

Q: Meri property meri beti damad ne girwi rakh di hai

Mere diwangat pati ne ek property kharidi thi or us property ko ragistered will k dwara meri beti or damad ke naam kar dia tha or unhone us property par khud guaranter banke damad ke bhai ko loan dila diya ab bank surfesi ki karyawahi kar rahi hai m budhi vidhwa maa apne ghar ko or rahne ki jagah ko bachakar road p aane se bachna chahti hu kripya mujhe batayen mein kya karu

Advocate Kartikeya Shukla answered

Q: Urgent Child Custody and Visitation Rights Advice under GWA Act

Advocate Kartikeya Shukla answered

Advocate Kartikeya Shukla answered

Q: How to prevent false SC/ST case while complaining against a SC/ST pers

A person from other colony is knotting his cow in front/ around my house from 3 years and is unfearful of any consequences. I doubt he is a SC/ST person by using the surname Solanki who are also rajputs. And a few of neighbours are also supporting him. How can I save myself from a false SC/ST complaint against me if he files. He has enough false witness who can say for him. What to do, please suggest. Tq

Advocate Kartikeya Shukla answered
The first step is not to take any action against the person merely because you suspect that he may belong to SC/ST or may file a false complaint. His caste by itself has no legal relevance unless the ingredients of a specific offence under the SC/ST (Prevention of Atrocities) Act are actually made out.You should immediately start maintaining evidence regarding the cow being tied/kept near your house—take dated photographs/videos, preserve CCTV footage, and keep records of complaints or requests made to the municipal authority/police/RWA regarding the nuisance. If possible, make a written complaint regarding the obstruction, sanitation or nuisance caused by the cow, without making any caste-related allegation or abusive remark. Most importantly, do not argue with him, threaten him, use caste-related words, or post anything about him on social media. If a complaint is subsequently filed, the defence can be based on the actual allegations, available evidence, CCTV footage, independent witnesses and whether the statutory ingredients of the alleged SC/ST offence are satisfied. If an FIR is registered, immediately obtain its copy and consult a local criminal lawyer. Depending upon the sections invoked and the facts, appropriate proceedings such as anticipatory bail (where legally maintainable), quashing or other remedies may be considered. A mere apprehension that someone may file a false SC/ST case does not itself establish an offence or require taking coercive action against that person.
