Q: Query regarding Possesion letter

I am going to buy a flat which was constructed and possesion given in 2010. i will be the third owner for this flat. flat is on finance and documents are in bank. while proceeding for the rgistration i came to know that the original possesion letter is missing which was issued to the first buyer from the builder.Is there any complecation to proceed on this deal.

You can contact the concerned builder to obtain the possession letter, they might charge you. However you must always have the chain of documents before proceeding further and it is also suggested to get the due diligence done before buying any property.



Q: Transfer of property in will case after death - haryana

We have a residential plot with 4 owners. My father(25%) , myself (25%), my wife(25%) and my brother(25%). My father has passed away leaving a will, giving his share of plot ownership to my brother. Now I wish to buy/transfer my brother's total share (50%) via gift or sale deed. My question is:1. Do I need to first transfer the my father's share to my brother using will in government records? 2. Or Sale deed/ Gift deed can be executed directly on the basis of will?Pls guide

The law in regards to WILL differ from state to state. It is always better to speak to a legal advisor/ lawyer in person to get your queries resolved. However in Haryana there is no provision of WILL probate and the process of transferring a property as per WILL is comparatively simpler.

My nephew got an ex-party court decree from Civil court Karnal 2-3 years ago for an ancestral property located at Gharaunda based on another ex-party decree of 1979.
