Q: Pending litigation in P&H High court since year 2000 and 26 years.

HSMITC was a state corporation closed in June 2002.It did not extend the 5th pay commission benefit to its employees from 01 01 1996.Writ filed by employees in 2000. The employees succeeded in single bench in 2012. Govt filed LPA. Matter pending since last 14 years. Petitioners now senior citizens aged 70-80, some died. I requested to CJ & RG of P&H court individually for priority listing and early disposal. Can I expect some action by CJ High Court where matter pending for more than 14 years.

We can file an appeal at the Supreme Court and get a favourable order regarding the issuance of directions to P&H High court to dispose of the case with relief within a time bound period. This order will be annexed at the high court to expedite trial and disposal of pending suit.

Q: property (shop in commercial complex) maintenance issue

the builder appointed maintenance agency for last 8 yrs is asking exorbitanr charges without any accountability to shop owners.most oeners have not paid for last 4 yrs and are not allowed to open their shops 1.what remedy do we have 2. does law of limitation of 3 yrs apply here (builder has not sued as his illegalities would come before court)

1.The appropriate remedy is to examine the builder’s agreement, the maintenance agency’s appointment and authority, the registered conveyance documents, and the applicable apartment/shop association rules. The shop owners may challenge arbitrary and unaccounted maintenance charges and seek restoration of access to their shops through appropriate civil proceedings, depending on the contractual terms and facts.2.Generally, yes, a three-year limitation period may apply to claims for recovery of money or other civil relief, depending on the nature of the relief and the applicable Limitation Act provision. However, it is not a blanket rule that every claim becomes time-barred after three years.Legal remedies are legal notice, civil suit, consumer commission and others depending on the facts and circumstances of the case

पड़ोसी की रजिस्ट्री 14 मरले की है, लेकिन फर्द और इंतकाल में गलती से 16 मरले दर्ज हो गया है। उस 2 मरले का कब्जा हमारे पास है। हमारे बीच पहले से विवाद है, इसलिए बिना विपक्षी को शामिल किए केवल रजिस्ट्री के आधार पर फर्द और इंतकाल में रकबा दुरुस्ती (फर्द बदर) करवाने की कानूनी प्रक्रिया बताएं। क्या राजस्व अधिकारी केवल रजिस्ट्री देखकर यह सुधार कर सकता है?"

राजस्व अधिकारी बिना नोटिस दिए और संबंधित पक्ष को सुनवाई का अवसर प्रदान किए, मात्र रजिस्ट्री के आधार पर फर्द/इंतकाल में किसी प्रकार का संशोधन नहीं कर सकता। जहां भूमि के क्षेत्रफल, कब्जे या अधिकार को लेकर विवाद मौजूद हो, वहां विधि के अनुसार दोनों पक्षों को सुनना अनिवार्य होता है। ऐसी स्थिति में मामला या तो विधिवत राजस्व कार्यवाही में तय किया जाएगा या फिर उचित राहत हेतु दीवानी न्यायालय का सहारा लेना आवश्यक होगा।

यदि आप अपनी निजी जमीन पर सभी जरूरी सरकारी नियमों का पालन करते हुए, आवश्यक अनुमति लेकर और इस बात का ध्यान रखते हुए कि पड़ोसी की जमीन या अधिकारों को कोई नुकसान न पहुंचे, कूप (कुआँ/बोरवेल) बना रहे हैं, तो केवल आपत्ति करने के आधार पर पड़ोसी आपको नहीं रोक सकता। लेकिन अगर निर्माण से किसी प्रकार की हानि, दिक्कत या कानून का उल्लंघन होता है, तो पड़ोसी अपने अधिकारों की रक्षा के लिए कानूनी कार्यवाही कर सकता है।
