Q: How to file a criminal complaint with the magistrate regarding fraud

How to file a criminal complaint with the magistrate regarding fraudulent withdrawal of money from banks.

Advocate Shimpi S P answered
By perusing his query it amounts to clear cheating to the bank to cause wrongful gain for himself and wrongful loss to the bank. Hence complaint has to be filed against him for the offence of cheating before the jurisdictional police with the copies of all relevant documents. If police have not filed Charge sheet against the accused then aggrieved part can file a private complaint before the jurisdictional magistrate u/sec 200 of crpc, give sworn statement marking supporting documents. Please contact me for further details.

Q: Cheating in the name of love and marriage

Hi,I started talking to a girl from March 2018. Slowly we started liking each other and we mutually spoke about love and marriage. Mid of March we planned for a day trip where she hugged me in bike, I kissed her forehead, cheek and she kissed my forehead. Nothing more than this happened. On that day I felt our characters doesn't match much. Evening she asked me if I can marry her, I said NO not possible as my parents will not agree and am also not interested. From that day she is threatening me by suicide. She filed a complaint on me in section 420 IPC cheating in the name of love and marriage. I was in jail for 5 days and now out by bail. Please help me to understand how this case will proceed. What will happen if I have promised to marry her? Will I be found guilty? In case if the honorable court finds me guilty what can be the result? What precautionary steps I need to take in case if she tries to commit suicide?

Advocate Shimpi S P answered
If both loved each other both mentally and physically, he cannot refuse to marry the girl loved. Otherwise it amounts to cheating and criminal case can be field against him and his family members. Please you can contact me for further details.

Q: Being forced to leave house by husband and in laws

I got married in 2019 and after 3 months my in-laws began verbally abusing me everyday and evicted me and my husband in the midst of the lockdown. I was not asked for dowry before marriage , however I was constantly abused saying if I brought dowry or was rich i would be treated better. My husband recently bought a house in another city and we moved here and have a baby. My husband frequeny harrases me to host my in-laws at home , despite them still being hostile to me. He uses foul words and says irrespective of how MIL behaves i have to oblige. On refusing to meet them in their city which I'm visiting for work , my husband with the advice of his parents has asked me to pack my things and leave to my parents house with our baby for good. Husband refuses to seek divorce for fear of having to pay maintenance to me . Says we'll stay separately and live own lives . Kindly suggest what I should do

Advocate Shimpi S P answered
It is the bounden duty of both of them to look after parents of husband. It is not a ground for divorce on fictitious grounds. As they are aged parents both husband sand wife have to look after them with love and affection. Please you can contact me for more details an instructions.
