We got engaged on 19th October 2025, and wedding got fixed on 6th of September 2026, now girl is not Interested to get marry and want to go legally mutual consent so that in future we will not get any trouble.

What do you expect the courts to do about a marriage which never happened? There are no legal provisions for formalising or nullifying an engagement. May be you both make an MoU and move on in life.



Q: Clarity on Monthly maintainence to husband

My husband is a serial entrepreneur and got good money after selling his shares in previous startup. That money has been invested in properties, Mutual funds etc in his name only. Right now he is not earning monthly from any job and gets interest monthly from his investments. He says that I have to pay him monthly maintainence in case i divorce him as I am working and he is not working and has no monthly salary. We have 7 yr kid and mostly all i pay for everything in house,school. Please advise

in Hindu marriage act there is a provision for claiming maintenance from wife. But for that he needs to prove his inability to wiand earn for himself like disease, lack of assets etc. it is very difficult for a healthy husband and almost impossible for him to succeed. Take the help of a good lawyer and some times offense is the best defence, by asking contribution for the maintenance and education of the child which is his primary dutt

Me and my husband staying in USA currently and would like to apply for mutual consent divorce due to some misunderstanding between us. We have a 7 years son. May I know the process to apply and any consequences we may face.

You need to file an application for waiving office the cooling off period for speedy divorce.if difficult for both of you to come together to India, one of you can file for a contested divorce, ask for mediation and obtain the divorce by the mediation report

Hi,My marriage was done in June 2024, my wife left home September 2024 and staying at her father house.regarding the house which is owned by me - in loan and EMI is going on.My Salary is Appx 2 Lakh - please suggest an escape from maintenance.She Filed false complaint against me in police Station.Note: I am ready to get another loan and clear my home loan, No children, wife left home in 3 months.she has planned to claim property and settlement and maintenance amount from me.

Is it NCR, or FIR or charges sheet stage. Go for Quash/ discharge accordingly. If case is strong with SC/st atrocities act, better get an anticipatory bail if still in the FIR stage.
