Questions Answered by Advocate Shaik Abdul Khader

Q: Fradulent forgery of plot situated in my father patta land in village.

My father is the owner of 10 acres of land in my village and my father is educated &bedridden recently and one person falsely created a fake sale document with a thumb impr dated 2016 alleging that my father has sold 2 guntas of plot from his land and that person did his family settlement by adding 2 guntas which is adjoining his previous house area and did registration of his family settlement to his son and now he is creating nuisance claiming that he had bought the 2 guntas from my father.

Advocate Shaik Abdul Khader answered
File a complaint with the Police authorities. if they don't register a FIR, stating that it is a civil issue then visit the ACP office. I would suggest you to make the lawyer draft the complaint for you(he will charge you 200-500 only) Or you use any GPT softwares to draft a complaint that includes all the relevant ingredients of the IPC. The same written complaint is attached to FIR. So if the FIR is strong, you have an upper hand. All the Best.

Q: Inquiry Regarding Maintainability of GWOP Case

Married 13 years ago to husband from Anantapur, Andhra state; endured physical abuse. Filed 498A complaint in Bangalore police station a year ago. Our 2 daughters, aged 11 and 3, reside and study in BLR for about a year. Aadhar and passport of kids, list BLR address. Husband filed RCR and GWOP case in his home city, anantapur, Andhra. Pls Let me know the maintainability of GWOP case. Received summon notice but didn't attend; case pending with new summon dates. How should I proceed ?

Advocate Shaik Abdul Khader answered
You filed 498A in Bangalore and have all id proofs of Bangalore. I presume you both lived in Bangalore for a couple of months. if my presumption is true then the Anantapur Court has got no jurisdiction to deal with this case. Just because he is residing now back in Anantapur the court doesn't get jurisdiction. Husband will most likely not succeeded in GWOP cases where the child is a girl even though Father is a Natural Guardian. You may delay the hearings or rush right away to state that it has got no jurisdiction. In these type of cases people usually delay it to make the other party suffer.

Q: Property Issue - brother is asking for half acre for jyesta bhagam..bu

My Brother and me divided the property and got registered with equal share but partition is not done yet. Now my brother is asking for jyesta bhagam. Is it mandatory to give jyesta bhagam? Im not willing to give jyesta bhagam.in that case how to partition my land. He is not agreeing for partition survey also. What should we do now.

Advocate Shaik Abdul Khader answered
As the dispute is over a land that has a good value and among the siblings, it is better to settle the issue amicably by involving your elders and VRO/MRO as well if you are in a rural zone else someone who is respectful. Settle the issue among yourself. But If you both stick adamant then you both have to pay lawyers their fee for years to resolve the partition suit issue. Your land your brother your choice.

Q: I lost my money by cyber fraud

I filled FIR against online Fraud as I lost money. Does this causes any issue when applying passport? Any issues in Background ground check when I join any software company? From few months I'm not getting good sleep because of these questions.please assist me on this?

Advocate Shaik Abdul Khader answered
Let me assure you that you have nothing to worry about. You were a victim neither an accused nor a convicted criminal. I come from Software industry prior to Advocacy. I predominantly deal with Cyber Crime cases only and I assure this again that you are safe and you have nothing to worry about. once the police recovers the money, you have to file a petition in the court and even then you have nothing to worry about. BGV of software companies is completely different process. So relax

Advocate Shaik Abdul Khader answered
If your uncle is a Hindu then search in google about Class-I hiers, and Class -II hiers. Check who so ever is alive. Even you may get the property as well. If the Class -I hiers are alive then Class-II hiers won't get it. Check the flow chart
