Questions Answered by Advocate Priyanka Yadav

Q: Request for Legal Representation – Wrongful Termination

Hi, I’d like to first know whether my case has legal merit before booking a paid consultation. I was terminated under a PIP process that violated natural justice, without show-cause notice, inquiry, or role-aligned performance metrics. I was an IC with no managerial powers, so believe I qualify as a workman under the ID Act. Kindly let me know if this falls within your expertise

Advocate Priyanka Yadav answered
For filing a case for Illegal termination, various factors need to be assessed like time period for which you served in the company. Illegal termination generally means termination: • Without proper notice or pay in lieu of notice. • Without following due procedure under law. • Without conducting a domestic enquiry in misconduct cases.Where to File a Complaint? 1. Labour Commissioner Office (conciliation process starts here) 2. Labour Court or Industrial Tribunal (if conciliation fails) 3. Civil Court or High Court (in some contractual or managerial cases) 4. Consumer Forum (if unfair trade practice is involved)

My wife cheated on me and filed false case against me. She is not leaving me from 3 years and also wasting my time...

Advocate Priyanka Yadav answered
Filing false cases is considered cruelty upon husband. Making false, defamatory allegations and filing false cases by the wife amounts to mental cruelty. You can file for divorce and get relief from wife. Make sure the divorce petition included all the points and specific allegations are made against the wife.
