Q: Playing cricket in residential areas in front of house and creating nuisance

Sir a group of guys play cricket in front of my house on street, mostly at night hours (9 pm to 11 pm),I requested them not to play here because it disturb us and also many window glasses are broken. But they misbehave and keep on playing. Earlier also when i asked them to stop they thrown stones at our house and ran away. is it legal to play cricket in society ?,What type of action i can take to stop them legally.

Dear Citizen,You are a victim of private nuisance in the present case. It is advisable that you file an application under S.133 of Code of Criminal Procedure before the Sub Divisional Magistrate of your locality and obtain prohibitory orders. You might have to engage an advocate for this application.In case the nuisance continues you can file an FIR before the concerned police station for house trespass and mischief under Indian Penal Code. Though it is not necessary but you should be able to identify atleast one accused and his residence for expeditious results.Regards,

Q: How to get stay on transfer order ?

I'm a sub inspector at Sagar ,due to some unknown issue I have got my transfer to another city till next order .I want to put stay on it. how to challenge transfer order ?

Dear Sir,Your problems seem to be one that generates from hierarchical structure of your institution. Transfer orders are often initiated at the behest of superior officers. The only way of putting a stay on your transfer order is to file a writ petition under Article 226 of the Constitution before the Madhya Pradesh High Court challenging the transfer as vicious and with ulterior motives. The state would be forced to bring on record all the documents on account of which your transfer has been initiated. You can challenge the validity of the transfer order being violative of Article 14 as it is unjust and arbitrary.

Q: what are the legal right in case of harassment of parents by son ipc

My brother and his wife are torturing my parents, who are both senior citizens. They are experiencing mental and physical harassment. I have two elder sisters, and whenever we discuss taking our parents to live with us permanently, my brother threatens suicide and claims he will leave a note accusing us. His wife has also threatened to report us for domestic violence. My parents and sisters are scared and don’t know how to seek legal help to get our parents out without facing any false allegations or repercussions. can parents file a case against son? Please guide us as we only want our parents to live with us and nothing else.

Rights of Senior Citizen are governed by Maintenance and Welfare of Senior Citizens (MWPSC) Act, 2007.As per S.4 of the Act, your parents can claim maintenance from their son by placing an application before relevant forum.Coming to the mental and physical torture. Your parents can lodge a police complaint against the son and his wife. I would also like to warn you that if the wife of your brother files a false dowry demand-cruelty complaint against your parents, your parents might have to face serious hardships in the court of law. In my personal experience old aged parents suffer the most in such cases. It would be preferable if your parents start living separately if possible and claim maintenance from your brother.

Firstly you have to ascertain if you see any future in such a relationship. If confrontation has not helped you earlier, it won't help you the second time. The real issue is whether it is time to start a separate life. Toxic relationship will leave you in more complex problems. It is advisable to send a notice for divorce. Along with that you can also seek maintenance for yourself and your child. Basically you might have to contest two cases. Relief from court might also take some time. Before you take any decision family counseling is advised. If it does not help you can seek divorce.
