Whether delivering liquor by ordering online legal

08-Dec-2023 (In Startup Law)
So basically our idea is to sell liquor online via app or website. Liquor delivery isn’t very uncommon- https://www.scoopwhoop.com/10-Liquor-Stores-In-Delhi-NCR-T…/ https://lbb.in/…/6-places-will-deliver-alcohol-right-door…/… But there aren’t any website/ apps for such in Delhi. There used to be http://Letsbuydrink.in & http://winebaazar.in but they have been shut down now. There have been other cases also like - http://www.dailymail.co.uk/…/Delhi-excise-department-busts-… So basically right now in India there is only one online liquor store - Liquor Store - http://www.madhuloka.com/ Also, liquor can be delivered in 2 ways - 1 We can stock up and sell our stuff 2 We can make a contract with local wine shop in most areas and deliver from there. The first one is illegal but the second one isn't exactly illegal. Having said so much, you must have realized that there are too many legal restrictions and we do need someone who can guide us through all of them

Hi.. An interesting question and business thought..

Firstly, liquor related law and regulation is a state subject, therefore every state has its own law regarding the same I.e. some states have complete liquor ban both online and offline like Nagaland, Gujarat, Lakhwadeep etc., Some states have limited restrictions on sale of alcohol especially hard liquor such as Kerala while some states prohibit delivery of hard liquor such as Delhi.

Therefore, though entering into the online liquor business does not appear to be illegal but it does come with strict legal regulations and restrictions.

Entering into online liquor business could be either through direct stocking up, sale and delivery, in which case you would be required to take state wise liquor permissions and licenses for stocking and sale apart from ensuring other legalities, or you could opt for a simple distribution model wherein you tie up with liquor stores, with no actual stocking up being done by you, but providing liquor stores with a platform for facilitating sale of their liquor stock and providing delivery services.

Irrespective of the model, you would have to adhere to the state laws of every such state the business wants to cater to such as stocking up, sale, delivery, customer age, sale timing etc. related restrictions and regulations, depending on the model chosen by you.

Hope the above is helpful. Feel free to contact us in case of further clarifications.

Alcohol comes under state list and every state has its own laws and age criteria set for the consumption of alcohol or for distribution of alcohol.
Then there are states like Mizoram, Bihar and Gujarat where selling of liquor is completely banned.
There are lots of laws and rules related to alcohol at state level which you need to comply first and then there are other general requirements at the central and ministerial level. One can help only when you discuss the whole plan of yours in detail.
