What is the Procedure to transfer property

Hello, My father passed away in 2009. We have a commercial property in a co-operative housing society in Mumbai which is in my father's name. I want to know the procedure to get the same transferred to my mother's name. Also, how can we add a nominee to the property. Further, I also want to know the significance of legal heirship certificate and the procedure to make one. Thank you.

First of all you have to get the succesion crrtificate in which the names of all legal heirs to be taken on record.
There after you have to apply to the housing society for
1. Recording the names of legal heirs of the deceased members on the record of the society
2. To transfer the share cetificates of the decrased member in the name of the legal heirs.
This procedure can be followed through the advocate

If your father died inteste then all of you I.e. your mother, Brothers and sisters if any are the legal heir of your father hence the property shall go in the name of all the heirs.
Further, if you want to transfer the property on your mother's name alone then the rest of all Legal Heirs can execute release deed and release your shale in the property in favour of your mother.
Once your mother become owner she can appoint any person as her nominee .
