What is the procedure to transfer the name in a property (plot) after the death of a person? Is it necessary to register a will? Being a legal heir of my grandfather I have a Will, a legal heir certificate, no objection affidavit signed by all the legal heirs in my favor. And how much money is required to transfer the name in a property as it is already registered in my grandfather's name. It's a property related question and I'm a Jain by religion.

Query perused. The property can be transferred in your name by applying for mutation with the MCD in case of freehold and with DDA in case of lease deed. Certain documents like affidavit, indemnity bond, death certificate has to be filed along. In case of unregistered will you need to file the NOC from other legal heirs. You simply have to get the mutation done of the property! It would just be the govt fee for the purpose of transfer of property! Its a 30 days process and you will get the mutation in your name. Your religion is no bar for mutation!

Hello sir, i have perused your query. In the above circumstances, if you have a will then you can register it and thereafter file for the probate of it in a civil court. Furthermore, you can get the property mutated or transfer the title / ownership in your name as well. For further information feel free to contact me.
