How can I transfer my parents property in my name.

12-Dec-2023 (In Property Law)
I am residing in a village near Madurai, Tamilnadu. I'm the only son for my parents and my parents passed away few years back. They are having around 4 acres agricultural land and home. I need assistance on transferring my parents properties to my name. Should I need to pay Stamp duty charges for transferring the properties from parents name to my name? Please let me know the procedure for this.

You said in question that you are the only son of your parents.in this situation you have to get death and legal heirship certificate from the concern department then you can apply the patta transfer in Taluk office . After verification of the records Taluk office will issue the patta in your name.

First of all ascertain that on whose names the properties stand or which of your parent has left behind the properties upon their intestate death.

Procure the death certificates of the deceased parents.

Apply and obtain legal heir ship certificate from the jurisdictional Tahsildar's office in respect of the legal heirs of the deceased parents by producing a copy of their death certificates.

On the basis of the legal heirship certificate, you may apply for mutation of revenue records from your parents' name to your name with the Revenue department/Tahsildar's office.

After that you can transfer all other records pertaining to the property to your name once you got your name mutated.

No stamp duty is required to be paid for this.

Since you are the only son of your parents, the property in their names can be transferred in your name. Towards this, you need to apply to the concerned revenue authorities with your parents' death, legal-heirship certificate and property documents.
