How can daughter claim share in fathers property
12-Jul-2023 (In Property Law)
My grandfather(mother's dad) has two sons and two daughters. He expired two years back. Now two sons are sharing my grand father's property worth 40 Lakh and they are giving one one lakh for two sisters. is it correct ? how much share two daughters deserves ?
Hi
I presume you are Hindu's.
Hindu succession act 1956 and Hindu succession amendment act 2005 will apply in your case.
Since your grand father died 2 years ago, as per Hindu succession act, your grand father's 2 sons and 2 daughter's will get equal share of the property. So the 40 lakh property will need to be shared equally between the sons, daughter's and wife.

HI,
no, it is not correct. two daughters are also entitled for equal share in the property.
your share will be 10 lakhs.
according to Indian succession act in the absence of any will or testament by the deceased the property
will devolve to his legal heirs equally.

the share that your mother gets depend upon the personal laws of parties i.e. their religion. Do not accept any amount nor sign on any document. Obtain the certify copy of property document from registrar office. You have a right to demand share in property.
