patients undergone emergency casearian section discharged in stable condition .dev pneumonia after 1 day kept on ventilator for 5 days ( in another hospital )and then died.post mortem of case not done to establish cause.not case is filed on lady doctor performing emergency casearian section .how it stand by the law
A complaint for medical negligence can be filed against the concerned persons in 1) the District Forum if the value of services and compensation claimed is less than 20 lakh rupees, 2) before the State Commission, if the value of the goods or services and the compensation claimed does not exceed more than 1 crore rupees, or 3) in the National Commission, if the value of the goods or services and the compensation exceeds more than 1 crore rupees.

U can file medical negligence case as well as a criminal case against d doctors and hospital. We need to examine patient's medical history and the steps taken by hospital management towards the case. If there is omissions on d part of hospital and doctors, we can proceed.
