Manager humiliated me I resigned company threatening for dues

07-Feb-2023 (In Labour & Service Law)

Dear Sir/Ma'm, I was employed with a company which sent me on a business migration to USA. After I signed my employment letter, I was told that I need to fly to USA immediately and have to sign the bond/service agreement. I had no option but to sign. When I came back the management changed my process to a different one. After that the manager in new process one day asked me to get out of office. Feeling humiliated, I resigned. However the company is now further mentally harassing me by sending legal notice for recovery of dues. The lawyer has also threatened to file a police complaint.

You have to share your employment letter. Have you abide by the terms of that agreement.
And you to show the legal notice. Make sure u reply to the legal notice. Otherwise it will be a problem for u at a later stage.
You have to give complete facts so that we can guide u accordingly

1. reply legal notice through lawyer and deny its contents specifically

2. file case in labour court against company and claim damages from company.

3. you can file writ petition in high court against company for illegally demanding dues from you.

The only mistake you did was "you resigned". You yourself gave the company/management various ways to twist your neck.

Now, everything depends on your appointment letter.
If it is written in your appointment letter that you will resign from the company by giving 1/2/3/4/5/6 month(s) notice and you have not given notice then you are liable to pay dues as mentioned in appointment letter.
And if you've already given them the notice for resignation then, you're not supposed to pay any dues.

In any of the case, we can contest the case for pain & mental harassment cased by company. In regard to this, we have got ways to proceed with our case.
Thanks.
