Verbal and emotional abuse by inlaws 8 month old baby how to proceed

21-Sep-2023 (In Family Law)
I am married and a mother of 8 month old baby. My marriage was in the year 2014. First issue was in the name of gold. It was kept under the custody of brother in law at their locker. When i demand a mutual account they created a big issue and throw me out of home. Then due to husband's demand and threatning i went to their home. When ever i went to my home for two days they will creat some issues. My siblings are in abroad. My mother is a widow. Now i am back in home for brothers engagement for two week. But they create issue with in two days saying that i have no rights to stay in my home. I am depressed.

The issues posted are too generic. So also, you are not specific as to the relief you seek. As such, it is impossible to make any meaningful suggestion. More than the law and the lawyers, it is your relatives and well wishers who are better placed to provide you any guidance.

Cruelty is an inhuman treatment and it is an act that causes mental sufferings and endangers to the life and health of the other.Though it is the women who have always been subjected to be tortured and harassed by the husband and relatives, in fact saying this will not be proper as cases of torture and harassment against the husband by the wife is increasing day by day.

The primary aim of the Protection of Women from Domestic Violence Act, 2005 is to provide protection to the wife or female live-in partner from domestic violence at the hands of the husband or male live-in partner or his relatives. The Domestic Violence Act includes actual abuse or the threat of abuse whether physical, sexual, verbal, emotional or economic and according to the law harassment by way of unlawful dowry demands to the woman or her relatives.

So you can file a case against in laws and seek protection. But best option is to try to settle the matter amicably with the help of relatives and close friends.
