Husband transferred wife saving into FD, how to recover

I am a retired Government servant. I have been giving my entire salary to my husband from day one of my marriage. His income stopped in 1997 due to paralysis. He has transferred all my savings in form of FDs and NSCs to my brother-in-law as well as DDA property. My two daughters are unmarried, observing the physical and mental torture of their father. What should I do to get my savings back and how should I secure my daughters' rights and future?

You aur your daughters can claim maintenance from your husband by this court will fix some amount which he shall pay on monthly basis. You need to file maintenance petition before court. By this only you can get financial help from your husband. On the other hand about your savings, if you have all the documentary proof which you can prove that you had transferred all your salary then you can file recovery suit against your husband.

Now the answer to your question cannot be given unless and untill you specify the mode of the transfer of your income to your husband and other vital information is required in order to give you a concrete solution. You have many option for your daughters for e.g you can file a maintenance petition for them (if they are minor), as i have already told you that more information and details are required but you have got many option for your problem.

You have only single ground against the husband for monetary relief is 125 crpc for maintenance. Else than that you can't prove it in court. Any other help or for the same u can contact me after getting the no from Lawrato.
