Husband not appearing before the court on court dates

My husband didnt attend first court date.judge has asked his advocate to make him appear on next date which is on 3rd sep. How many chances of his to come? Does his advocate make him to appear or will suggesr him something else? Can his advocate only attend d 2nd date or make husband to come.? What his advocate could do more to harrass me?

He can do a lot to harass you in this legal battle. But you don't worry, try to communicate with your lawyer of your situation and put pressure to the court so that the court can compel your husband through his counsel by imposing cost or by striking of his defence and many more way to compel your husband if he voluntarily avoiding his appearance. If it is a case of divorce and maintenance, he will not pay you easily. You have to fight in the court of law through your lawyer. Revert me if you have any other problem regarding this. You must have engaged Advocate, he is the best person to ask these questions. However, if direction to be personally present for your husband is upon Court order sheet then your husband has to appear as nobody can refuse to follow directions of Hon'ble Court. In case the order is not upon Court's order sheet then it is to be seen whether the petition is under Domestic Violence or 125Cr.P.C. or for Divorce under Hindu marriage Act or it is anticipatory bail petition filed by your husband.

Your husband is not required to be present in court on all days. His lawyer can represent him on his behalf. However, if the judge requires his presence, your husband might be allowed a couple of chances to appear if his advocate can show bona fide grounds for his inability to attend the courts. However, the judge has the powers to send summons followed by warrants where he may be presented with the help of the police.

You have not told about the case in which you seek her attendance and Why u feel he should appear him self. If it is civil case then his presence is not necessary as he is appearing through his his advocate. Though in criminal case he can be forced to appear. So please give details of your case so as to get proper advice or u may call me in case of need
