Brother filed false DV case against us and our father what can be done

Due to negligence n indifferent attitude of my brother my father had disown my brother in a newspaper n filed written complaint against him and his wife last year now this year both of them have filed domestic violence Case against my father me my sister n our husband. Brother n his wife have occupied d house. V sisters r taking care of our aged father at our place.

Ur query is incomplete , u should not interfere in ur brother family matter seems unless u r interested in the property, u can file a separate suite for division of property in civil court demanding our portion in the property.

Where was your brother living prior to taking possession of the said house? Was your father also living in the same house? You can file a complaint against your brother and his wife regarding this matter and you will also have to contest the case that has been filed against you and your family. The complete set of papers would be required to give you the best advice.

You'll have to contest the DV case filed by your brother by putting an appearance in the concerned court through an Advocate. While you'll do do so, you'll have to bring the true and correct position before the court so as to establish that the DV case is in retaliation.

If the case of domestic violence has already been registered you should face the inquiry and if you are not guilty for the same you have nothing to worry ,by the way you can mool High Court of your district's jurisdiction to quash the FIR. So far as the house is concerned they can't accupy it without consent of you and your sister as all of you have the equal right upon tha house of your parents.

There is no provision to file domestic violence case by a male.only female can file complaint under the domestic violence act.The act defines domestic violence as harassment conducted against females . Hence you can approach the high court to quash the compliant or file objection before the magistrate court to dismiss the complaint.
