दादाजी की पुश्तैनी जमीन है। मौखिक बंटवारा सालों पहले हो चुका था और रोड साइड जमीन पर हमारे पिताजी का कब्जा है। उन्हें पीएम किसान सम्मान निधि भी मिलती है। लेकिन खतौनी में नाम अभी भी एक साथ (साझा) दर्ज है। अब चचेरे भाई ने रोड साइड की कीमती जमीन के लिए हमारे खिलाफ बाराबंकी के हैदरगढ़ कोर्ट में धारा 116 के तहत बंटवारे का केस कर दिया है। हमारा वकील ठीक से पैरवी नहीं कर रहा है। कृपया बताएं कि हम कोर्ट में अपना मौखिक बंटवारा और रोड साइड का कब्जा कैसे साबित करें और विपक्ष का केस खारिज कराएं?

मौखिक बंटवारे के महत्वता कम हैं, अगर बरसो से आपका कब्जा बरकरार है तो आपको उसके साक्ष्य देने होंगे जैसे बिजली बिल , खेत जोताई, फसल लेबर का खर्चा , फसल बेचने के कागज , अपने कब्जे वाले हिस्से के किसी भी प्रकार के खर्चे या मरम्मत के कागज , बिल इत्यादि और आपका कब्जा शांतिपूर्ण भी होना चाहिए , साथ ही गांव के लोग इत्यादि गवाह के रूप में होंगे तों आपका केस मजबूत होगा । बंटवारा न्यायालय लिखित करता है काग़ज़ के आधार पर ।

i am grandson of my grandfather having 3 sons and i am bigger son of his bigger son and during partition they my grandson gave the property of his bigger son (my father) to me not my father but after his death my property is given to my father and i dont have older papers i want it back
