You cant take divorce before separation period of one year and then 7 months for filling first motion and second motion. You hv to show that u r living separately for the period of one before filling first motion petition and after six months second motion petition

Hi.
As per the Hindu Law, you can go for divorce only after one year of marriage.
There is another option which is different from divorce but you can't remarry during that period.

Waiting time is for 6 months. After a settlement deed between both of you, first motion will be filed and then after completion of six months, you can file 2nd motion to get a final decree of divorce.

The waiting time is minimal one year so another six months to go and there should be no consummation of marriage in that one year duration then you can go ahead and file divorce on mutual consent..Which can be granted.
