If you perform the saptapati and the other necessary rituals which makes the marriage between two hindus a valid marriage. Then it will be binding upon u and you can not remarry during the lifetime of the spouse living . you will have to file for divorce else you can not remarry and if you do that despite the fact that you have a living spouse , you can be charged for bigamy.

Marriage is marriage whether its before arya samaj mandir or court or any temple. To dissolution of marriage you have to file proper petition before the court of law and obtsin appropriate order from court of law

You can seek cancellation of the same or seek declaration of the said certificate as null and void or infact for even better clearance go for a divorce which can be done within a period of one month or two months at max.

If the marriedge is not consumated it cannot be completed it is void and easly can demand divorce on these facts. Age and consent would be also an important fact in this regard.
If you and anyone did not hear about hear your partner for 8 years it is automatically dissolve
