Married for two years but never lived together, how to seek separation

My brother is deaf and dumb and he was married to a village girl in january 2014. the girl went to her home in march but never returned till today. my brother used to live in baroda but now he is in noida and the girl was not aware of it and she went to baroda and is now making a scene there to take her in the family again. the problem we are facing is that we do not want her in the family because she had some affairs during the period she was at her home and still married to my brother. Is there anyway to keep her out because she is not ready to give divorce unless we give her 1 crore. my brother is not working because of his problem and the girl was well aware of it before the marriage but is asking for money from his father who is a government officer. what are our options? how can we get divorce?

Your brother can institute case of adultery and divorce on the basis of desartation but your brother have to give some money as almony .he can give her one time almony form of some money .you have to explain that your sister in law was deserted your brother .

You can easily file case of divorce on the basis of cruelty, desertion,in Greater noida family court.
It will be better if you take help of lawyer for speedy proceedings with help of certain documents it will be easy for you.

If the house is your father's house, she can not enter. Your brother needs to file a suit for divorce in Noida. Meanwhile you can send a letter of complaint. If she has left on heer own and desserted your brother, she cannot claim any maintenance. You father is not liable to pay for your brother's wife. If she is claiming also, she wont be able to get this through court. It will be better to consult a lawyer and file a suit for divorce the ealiest.

As per Hindu marriage Act ,there are lot of provision given under the act ,section 13 of the act defines that with that conditions under which it could be given had been difined and elaborate by court from time to time ,in your case there some point which is in your favour ,kindly provide details for further analysis and advice .
