you can file Domestic violence case. Yes you can also file case for legal separation. You can also seek maintenance for you and your kids u/s 125 Crpc.
Hi I am a married woman of age 46. I have two kids age 16 and 22. My husband has been cruel to us always.verbal nod physical abuse is a normal phenomena for him.he is has some mental problem. He is abusive only towards us and when no outsider is there.otherwise he behaves very normal in front of other. This is his behavior pattern. Now Me and my sons cannot take his dual behavior any. More.he never feel regretted or sorry. He is always questioning me and doubting me. I am non working for 4 yrs.my kids are still studying..what can be done on my case.now can I ask for legal separation and kid

If your husband is of such a nature. You should have approach the court previously. Still it's not too late. If you want divorce or just a separation in both the cases you have to approach to the court with the application. You have to satisfy the court why do you want separation? For this purpose, note down some reason which amounts to hardship with you and your children. Dual behaviour is very irritating but court needs something more for allowing your application. Think over it. Revert me. All the best.

as per hour query you are married for a long time and your husband is treating you with cruelty.now you can file a case against him in women cell under section 498A IPC as well as section 12 of DV Act.Moreover as you are unemployed and housewife you can also file petition under section 125 CRPC for grant of maintenance.

You have sufficient grounds for judicial separation. You and children will also receive maintainence from your husband. You need to file suit for judicial separation and maintaininence. Obviously, no person can stay in such situation. Decide firmly, then go further. God bless you

Now a days the approach of judiciary os getting shifted. First of all you have to creat evidences that there is actually certain rash behaviour from opposite sode i.e. Ur huabad try to record the moments which you think is cruely against you and do not forget to file complat to appropriate authorities. After havinf sufgicient evidence you can move to court for appropriate remedy. I.e. For judicial seperation, divorce and maintainance etc.
